If PHP-Mods provides you with a user ID and password to enable you to access restricted areas of this website or other content or services, you must ensure that the user ID and password are kept confidential.
PHP-Mods may disable your user ID and password in PHP-Mods sole discretion without notice or explanation.
In these terms and conditions, your user content means material (including without limitation text, images, audio material, video material, audio-visual material and login credentials) that you submit to this website, for whatever purpose.
You grant to PHP-Mods a worldwide, irrevocable, non-exclusive, royalty-free license to use your user content in any kind of services offered to you including newsletter emails. You also grant to PHP-Mods the right to sub-license these rights, and the right to bring an action of infringement of these rights.
Your user content must not be illegal or unlawful, must not infringe any third party's legal rights, and must not be capable of giving rise to legal action whether against you or PHP-Mods or a third party (in each case under any applicable law).
You must not submit any user content to the website that is or has ever been the subject of any threatened or actual legal proceedings or other similar complaint. PHP-Mods reserves the right to edit or remove any material submitted to this website, or stored on PHP-Mods servers, or hosted or published upon this website.
Notwithstanding PHP-Mods's rights under these terms and conditions in relation to user content, PHP-Mods does not undertake to monitor the submission of such content to, or the publication of such content on, this website.
This website is provided "as is" without any representations or warranties, express or implied. PHP-Mods makes no representations or warranties in relation to this website or the information and materials provided on this website.
Without prejudice to the generality of the foregoing paragraph, PHP-Mods does not warrant that:

- the information on this website is complete, true, accurate or non-misleading.
Nothing on this website constitutes, or is meant to constitute, advice of any kind.

- matter which it would be illegal or unlawful for PHP-Mods to exclude or limit, or to attempt or purport to exclude or limit, its liability.
By using this website, you agree that the exclusions and limitations of liability set out in this website disclaimer are reasonable.
If you do not think they are reasonable, you must not use this website.
You accept that, as a limited liability entity, PHP-Mods has an interest in limiting the personal liability of its officers and employees. You agree that you will not bring any claim personally against PHP-Mods's officers or employees in respect of any losses you suffer in connection with the website.
Without prejudice to the foregoing paragraph, you agree that the limitations of warranties and liability set out in this website disclaimer will protect PHP-Mods's officers, employees, agents, subsidiaries, successors, assigns and sub-contractors as well as PHP-Mods.
Only one promotion can be used per order. Multiple promotions cannot be used and combined together. PHP-Mods reserves the right to refuse a promotion to a customer. PHP-Mods reserves the right to revoke a promotion which has been already used or a new promotion with or without prior notice.
PHP-Mods reserves the right to reduce the advertise total and/or time of promotion with or without prior notice.
You hereby indemnify PHP-Mods and undertake to keep PHP-Mods indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by PHP-Mods to a third party in settlement of a claim or dispute on the advice of PHP-Mods's legal advisers) incurred or suffered by PHP-Mods arising out of any breach by you of any provision of these terms and conditions, or arising out of any claim that you have breached any provision of these terms and conditions.
1.13 Breaches of these terms and conditions
Without prejudice to PHP-Mods's other rights under these terms and conditions, if you breach these terms and conditions in any way, PHP-Mods may take such action as PHP-Mods deems appropriate to deal with the breach, including suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you.
PHP-Mods may revise these terms and conditions from time-to-time with or without prior notice to you. You acknowledge and you agree that it is under your responsibility to review these Terms and Conditions from time to time in order to check any modifications made. Revised terms and conditions will apply to the use of this website from the date of the publication of the revised terms and conditions on this website. Your continued use of this site or any service related to this email after such modification will constitute acknowledgment of the modified Terms and Conditions and agreement to abide and be bound with them.
PHP-Mods may transfer, sub-contract or otherwise deal with PHP-Mods's rights and/or obligations under these terms and conditions without notifying you or obtaining your consent. You may not transfer, sub-contract or otherwise deal with your rights and/or obligations under these terms and conditions.
If any provision of these Terms and Conditions is, or is found to be, unenforceable under applicable law, that will not affect the enforceability of the other provisions of these Terms and Conditions. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.
These terms and conditions constitute the entire agreement between you and PHP-Mods in relation to your use of this website, and supersede all previous agreements in respect of your use of this website.
These terms and conditions will be governed by and construed in accordance with Greek Law, and any disputes relating to these terms and conditions will be subject to the non-exclusive jurisdiction of the courts of Greece.

2. Digital Products
As soon as the order has been completed, the digital product should be ready for download via the PHP-Mods billing system. Our Staff is regularly checking your products availability and updates them when it is needed.
PHP-Mods Team offers support for the PHP-Mods products via live chat, support tickets, emails and Skype. You are entitled to receive support when you need it which is limited to the PHP-Mods products only. Support is limited up to two (2) years from each product's purchase. Violation of any of the Terms and Conditions of this document, may result the rejection of further support for the products you purchase via our system.
The files you have purchased should be used by one website directory only. You must be the owner of the website. If you wish to install the files on several website, you must purchase a separate copy of every digital product for every website.
Refunds are not offered for any of our digital products.
Each module license is valid forever, it does not expire and it includes two years of free support and updates. The renewal of Support and Updates service is optional and it gives you access to the module's files, future version updates and our technical support team. The price of the support and updates service is 50% of the product's initial price for the extension of two (1) extra year and so on.
3. Domain Name Registration
We make no representation that the domain name you wish to register is capable of being registered by or for you or that it will be registered in your name. You should therefore not assume registration of your requested domain name(s) until you have been notified that it has or they have been registered. Any action taken by you before such notification is at your risk.
3.2 Registration and Use Terms by Naming Authority
The registration and use of your domain name is subject to the terms and conditions of use applied by the relevant name authority; you shall ensure that you are aware of those terms and conditions and that you comply with them. You shall have no right to bring any claim against us in respect of refusal to register a domain name. Any administration charge paid by you to us shall be non-refundable notwithstanding refusal by the naming authority to register your desired name.
3.3 Disputes between you and third parties
We shall have no liability in respect of the use by you of any domain name; any dispute between you and any other person must be resolved between the parties concerned in such dispute. If any such dispute arises, we shall be entitled, at our discretion and without giving any reason, to withhold, suspend or cancel the domain name. We shall also be entitled to make representations to the relevel naming authority but will not be obliged to take part in any such dispute.
We shall not release any domain to another provider unless full payment for that domain has been received by us.
4. Web Hosting Services
PHP-Mods make no representation and give no warranty as to the accuracy or quality of information received by any person via the Server and we shall have no liability for any loss or damage to any data stored on the Server.
You shall effect and maintain adequate insurance coverage in respect of any loss or damage to data stored on the Server.
4.2 Spam, Warez, Piracy and Illegal Activities
You represent, undertake and warrant to us that you will use the Web Site allocated to you only for lawful purposes. In particular, you represent, warrant and undertake to us that:
- 4.2.1 you will not use the Server in any manner which infringes any law or regulation or which infringes the right of any third part; nor will you authorize or permit any other person to do so.
- 4.2.2 you will not post, link or transmit:
- (a) any material which is unlawful, threatening, abusive, malicious, defamatory, obscene, pornographic, blasphemous, profane or otherwise objectionable as determined by PHP-Mods in any way.
- (b) any material containing a virus or other hostile computer program.
- (c) any material which constitutes, or encourages the commission of a criminal offence, or which infringes any patent, trade mark, design right, copyright or any other intellectual property right or similar rights of any person which may subsist under the laws of any jurisdiction.
- you will not send bulk email, whether opt-in or otherwise, from our network. Nor will you promote a site hosted on our network using bulk email.
- you will not employ programs which consume excessive system resources including, but not limited to, processor cycles and memory. We do not host IRC, IRC bots, or other server resource intensive programs.
PHP-Mods will remain the sole arbiter in what constitutes any of these activities. You acknowledge that participation in any of these activities will result in immediate termination without refund. PHP-Mods may involve law enforcement authorities if we deem necessary.
If PHP-Mods discovers child pornography on any services provided to you, your account will be immediately terminated without refund. Your personal details will be passed to law enforcement authorities and we will assist fully with law enforcement authorities around the world to seek the required charges against you.
PHP-Mods provides its clients all the tools needed to create backups of account data. It is the responsibility of the customer to keep up-to-date archives of their backed up data. PHP-Mods does not take backups of customer websites. Your data is stored on a storage platform with hardware redundancy to protect against data loss though hardware failure but we are not responsible for data loss caused by customer error. Although saying this we do take backups of our web hosting plans once a day (time varies). These backups are kept for 7 days, after these 7 days the backups are deleted, however these backups are in case of hardware failure and no for customer use.
If you account was canceled or suspended or terminated for non-payment or any terms violation and you still need your data to take with you there is a 20$ per incident charge for all inquiries regarding previous services and/or support. We generally keep backups available for a period of 30 days after account cancellation but can provide no guarantees on the actual length of availability of a backup.
PHP-Mods has strict resource usage restrictions on Web Hosting Services. These are designed to maintain the integrity, security and performance of our web servers. Failure to abide by these restrictions may result in account suspension or termination without refund.
- No script or piece of software may use 25% or more of system resources for 60 seconds or longer;
- No user may have above 5,000 opened files at any moment (the limit does not apply to overall number of existing files, owned by the user);
- The number of emails sent from all email accounts at the same domain name cannot be more than 200 per hour;
- Running stand-alone, unattached server side processes/deamons is strictly prohibited;
- Running any type of web spider / indexer (Google Cash / Ad Spy) is strictly prohibited ;
- Running any bit-torrent / P2P application is strictly prohibited;
- Running cron scripts with intervals of less than 5 minutes, or setting up more than 3 simultaneous cron jobs is strictly prohibited;
- Running of public file exchange services is strictly prohibited.
Data under your account can not occupy more than 250,000 nodes on disk. Cumulative automatic backups of your data on default local automatic backup storage can not occupy more than 20 Gbytes of space. User initiated data backups are intended for download and can not be stored under user's home directory for more than 10 days.
You are not allowed to use any nulled third party software on PHP-Mods Servers. The use of nulled software may result in account suspension or termination without refund.
4.7 Surpass Allocated Resources
If you surpass your allocated disk/bandwidth usage as set forth in your purchased plan, you agree to purchase and upgrade to the next available web hosting plan. Such payment to be immediate and non-disputable.
PHP-Mods Team reserves the right to suspend and/or terminate your account with or without warning to the client. PHP-Mods Staff reserve the right to suspend your access for 24 hours with a valid reason to you. If your account or service gets suspended without warning please contact us and we will do our best to help you get your website back online if there is not any problem.
PHP-Mods Team reserves the right to terminate your account after 30 days of suspension. PHP-Mods Staff is not required to keep any backups of your web hosting account after your account's termination.
You may cancel the Services at any time by logging into the PHP-Mods System (for verification) and requestingcancellation of any service or via opening a support ticket under PHP-Mods Billing Department.
Requesting a cancellation does not give you the right to request a refund for any unused portions of the period you have already paid for even if the cancellation takes effect immediately. You are entitled for a refund as soon as you comply with part 4.10 of these Terms and Conditions.
4.10 Thirty (30) Day Money Back Guarantee
All our web hosting plans come with a 30 day money back guarantee.
If you have previously used the 30 day money back guarantee and you sign up at any point in the future then the 30 day money back guarantee will not apply to you.
Violating any part of the agreement will exclude you from the 30 day money back guarantee.
Refunds can be requested via opening a support ticket under PHP-Mods Billing Department within 30 days of the service activation. Once 30 days have passed, you can no longer use the 30 day money back guarantee.
If you have used any promotion related to web hosting services then the 30 day money back guarantee will no longer apply to you.
You agree and you understand that the usage of any promotional code provided with the purchase of any web hosting plan may affect the total refundable amount.
5. Custom Projects
Quotes are being sent within 48 hours after your request. Quotes include all the information about the project’s development, the final quote and any further Terms and Conditions.
Any Terms and Conditions inside the document of the final quote replace all of the Terms and Conditions published in PHP-Mods Website.
Quotes are valid for 30 days from the shipment to the customer. After this period of time, they are subject to changes if we deem necessary.
Support is being offered for all the errors which might occur via support tickets and live chat. PHP-Mods is not required to offer support to products which have been developed two years or more after the date of the final payment.
Any minor updates of the final project which will be handled to you, will be offered for free. Any extended updates may require an extra cost based of the type of development. A third party developer can be hired to update your project with the appropriate respect to the Terms and Conditions provided here or inside the document of the final quote.
Before the start-up of the project, you will have to send us the required deposit which will be set inside the quote document. This deposit should be sent to us via PayPal after the required arrangement by a member from our Team.
If you decide to cancel the project, PHP-Mods is not obliged to refund you the deposit and you will not be allowed to use part of or the whole part which you might have received from our Team.
If PHP-Mods decides to cancel the project for any reason, the deposit should be refunded. If you wish to use the project as it is (on its current development status) the final quote will be based on the stage of the development.
The final project cannot be resold or distributed by you or anyone else than us to another person/company. PHP-Mods has the right to release the project or part of it (excluding any template files, audio-visual material or any other copyrighted material) in public at any price.
Any redistribution rights or non-redistribution requests should be discussed before the shipment of the document of the final quote.
Deadlines shall only be binding once PHP-Mods has confirmed the deadlines in writing. The deadline of the project is included in the document of every quote. The job shall be considered late once the first deadline has passed. You have the right to withdraw from the contract, refuse to accept the project and request the refund of the deposit only after the deadline date has passed. Clients do not have the right the claim any further compensation if the project does not get completed unless it is previously stated in the document of the quote.
A Non-Disclosure Agreement (NDA) Document can be signed off by PHP-Mods as per your request or our discretion without any extra cost.
